1) Scope of Application

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of MyCommerce Limited (hereinafter referred to as "Seller") apply to all contracts for the supply of goods concluded between a consumer or entrepreneur (hereinafter referred to as "Customer") and the Seller via the Seller's online store. The inclusion of the Customer's own terms is hereby objected to unless otherwise agreed.

1.2 These GTC also apply accordingly to contracts for the supply of vouchers unless otherwise specified.

1.3 A consumer is any natural person who concludes a legal transaction for purposes that predominantly are outside their trade, business, or profession.

1.4 An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.

2) Conclusion of Contract

2.1 Product descriptions in the Seller's online store are not binding offers but serve for the Customer to submit a binding offer.

2.2 The Customer can submit the offer using the online order form integrated into the Seller's online store. By clicking the button concluding the ordering process, the Customer submits a legally binding contractual offer regarding the goods in the shopping cart.

2.3 The Seller may accept the Customer's offer within five days:

  • by sending a written order confirmation or an order confirmation in text form (e.g., by e-mail);
  • by delivering the ordered goods;
  • by requesting payment from the Customer after placing the order.

If several of the aforementioned alternatives apply, the contract is concluded when one of the alternatives first occurs.

2.4 If payment is processed via PayPal or Amazon Payments, the contract is concluded upon confirmation by the respective payment service provider.

2.5 Contract text will be stored by the Seller and sent to the Customer in text form after the order is placed.

2.6 The contract language is English.

2.7 The order processing and communication take place via email. The Customer must ensure that the email address provided is correct and that emails can be received.

3) Right of Withdrawal and Voluntary Return Policy

3.1 Consumers in the European Union have a statutory right of withdrawal. Details are outlined in the separate Withdrawal Policy.

3.2 Voluntary 30-Day Return Policy: In addition to statutory rights, we offer a voluntary 30-day return policy for unused products. "Unused" means the item must not have been operated or used and must be in its original condition and packaging. This policy does not affect your statutory rights.

3.3 Returns for International Customers (Non-EU): Customers outside the EU may return unused goods within 30 days of receipt under our voluntary return policy. Returns must be shipped at the Customer's expense and risk unless otherwise agreed.

4) Prices and Payment Conditions

4.1 Prices shown include VAT if applicable. Additional shipping costs are indicated separately.

4.2 Additional costs (e.g., duties, bank charges) may arise for deliveries outside the EU, payable by the Customer.

4.3 Payment options are communicated in the Seller's online store.

4.4 Payments are due immediately unless otherwise agreed.

5) Delivery and Shipping Conditions

5.1 Delivery occurs to the shipping address specified by the Customer.

5.2 If delivery fails due to Customer fault, the Customer bears reasonable costs.

5.3 Risk transfers upon handover to the Customer or a designated person.

5.4 In case of third-party shipment arrangements by the Customer, risk transfers upon handover to the carrier.

5.5 Self-collection is not possible.

6) Retention of Title

The goods remain the property of the Seller until full payment is received.

7) Liability for Defects (Warranty)

7.1 Statutory warranty rights apply unless otherwise specified.

7.2 For entrepreneurs, the warranty period is one year from delivery.

7.3 Exclusions: damage caused by misuse, external factors, or unauthorized modifications.

8) Redemption of Promotional Vouchers

Promotional vouchers can only be redeemed within the specified validity period and conditions. They are non-transferable and not redeemable for cash.

9) Redemption of Gift Vouchers

Gift vouchers can be redeemed for products in the online store. They are valid for three years from the end of the year of purchase.

10) Extended Warranty

A voluntary 5-year warranty extension applies to the DOYOO AirPro Supersonic High-Performance Hairdryer, covering material and manufacturing defects under normal use. Processing and shipping fees of USD 24.90 apply for warranty claims.

11) Disclaimer of Warranties and Limitation of Liability

The services and products are provided "as is" and "as available" without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

The Seller is not liable for indirect, incidental, punitive, or consequential damages. Liability is limited to the purchase price paid by the Customer.

12) Use of Third-Party Services

The Seller may engage third-party service providers (e.g., Shopify, Stripe, PayPal) for service delivery. The Seller is not responsible for the performance of these services unless due to negligent selection or supervision.

13) Applicable Law and Jurisdiction

The law of Hong Kong Special Administrative Region applies, excluding CISG.

The courts at the Seller's registered office have exclusive jurisdiction. The Seller reserves the right to bring claims at the Customer's place of residence. Mandatory consumer protection laws of the Customer's country remain unaffected.

14) Alternative Dispute Resolution

The Seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board outside the European Union.
